RIGHTS AND FREEDOM
  1. ASSEMBLY AND PROCESSION :
  2. According to the Bangladesh constitution you have the fundamental right to do this. But you can do this with certain restriction imposed by the police.
    1. Police can determine the conduct and behavior of the people of assembly.
    2. Any superior authority of police can direct the processionthe way of movement.
  3. USE OF LOUD SPEAKER :
  4. It is your right to use loudspeaker but certainly you can’t be annoyance to anybody. For the safety and security of public interest police can control it.
    1. Government office
    2. Mosque, Mandir, Church
    3. Educational institute
  5. DISTRIBUTION OF LEAFLETS AND CARRING OF PLAYCARDS :
  6. You have the right to carry placards. The government can by notification control the size of sick.
  7. UNLAWFUL ASSEMBLY
  8. According to the penal code of Bangladesh if five or more persons joins together for an unlawful purpose is called unlawful assembly.
  9. PICKETING
  10. Picketing in a peaceful manner is lawful. But it is unlawful if the force is used.

FACING OF POLICE

  1. SOME INFORMATION
    1. You must be informed of the cause of arrest (Article 33(1) of Constitution.
    2. You are authorized to consult with the lawyer of your choice (Article 33 of the Constitution).
    3. You must be produced before the magistrate within 24 hours (Code of Criminal Procedure Section 61)
    4. If the offence is bail able and if you are ready to give bond then you will be released on bail.

  4. WHO CAN ARREST
    1. Any police officer not below the rank of sub-inspector (Code of Criminal Procedure Section 54)
    2. A citizen of the country under Section 59(1) of the Code of Criminal Procedure.
    3. A magistrate under Section 59(1) of the Code of Criminal Procedure.
  5. RIGHT OF LOOKING FOR WARRENT OF ARREST :
  6. According to the Section 80 of Code of Criminal Procedure the police officer will show the warrant to the arresting person.
  7. CAN SOMEBODY BE HANDICAPPED :
  8. According to the Section 160 of Bengal Police Regulation 1915 the following persons are not be handicapped.
    1. Member of the Parliament
    2. Soldiers in uniform
    3. Political personnel’s
    4. Sick or old persons without the advice of the doctor.
    5. Female
    6. If the accused is in lockup
    7. The accused is in the Court and the court ordered to open it.
  9. WHEN POLICE CAN USE HANDCAP:
    1. If the offence is not bail able and a punishable offence of more than 3 years.
    2. Accused of serious offence
    3. Theft or
    4. Indiscipline
  10. OBSTRUCTION DURING ARREST :
  11. According to the Section 46(3) of Code of Criminal Procedure if the accused wants evade the arrest he has to apply the same force.
  12. RIGHT OF SEARCHING OUT BODY :
  13. According to the Section 51 of Code of Criminal Procedure the police has the right to search the body. But a woman must search the body of another woman.
  14. HOW TO IMMUNE IMMEDIATELY :
  15. If you are arrested then without going to the court you can get bail in the police custody.
    1. If the Magistrate gives the direction that with taking a bond the individual can be set free.
    2. If the offence is bail able and the individual is arrested without warrant he can bail.
    3. The individual who is arrested by the police officer he can get bail by giving bond.
  16. RIGHT OF ARRESTED PERSON WHEN HE WAS TAKEN TO THE POLICE STATION
    1. Ask for the bail and ask him why and under which law he was arrested.
    2. Don’t give any statement that you will get bail.This will go against you.
  17. BEFORE THE MEGISTRATE :
  18. Any criminal complains is lodged against you have the right for application of bail.
  19. CONDITION OF BAIL :
  20. Magistrate can serve bail
    1. with condition
    2. without condition
    3. with bonds that the bailer will be present.
  21. BOND OF ACCUSED AND BAILER :
  22. Any person giving bail if the court thinks he will be given a bond with such amount of money as the court thinks fit.
  23. AFTER PUNISHMENT :
  24. If you are accused in the court of justice for any offence you can ask bail to the court for a time being to get the time of appeal to the higher court.
  25. RIGHT OF GETTING DUPLICATE COPY OF JUDGEMENT
  26. You have the right to get copy of judgement without cost.
  27. APPLICATION FOR BAIL TO THE HIGHER COURT :
  28. If the trail court ignored your bail then you have the right to go to the higher court for bail.
  29. WRIT PETITION :
  30. If you are unlawfully arrested and within 24 hours you are not taken to the court then according to the article 102(2) of the Bangladesh Constitution any of your nominee can give a petition of writ of habious corpus to the high court.

CUSTODY OF POLICE

  1. RIGHT OF POLICE :
  2. According to the Identification of Prisoners Act,1920
    1. Taking photograph.
    2. Taking Measurement and impression of fingers.
    3. Interrogation :
    4. Section 161 of court of criminal procedure.
      1. A police officer not bellow the rank of Sub Inspector who is investigating the case can take oral evidence to the individuals whom he is thinking of the fact in issue.
      2. The individual is bound to all the question but is not bound to answer any question incriminates him.
    5. Torture :
    6. Police is not above the law. It is unlawful for torturing in the period of arrest. If the police torture you.
      1. Write the name and number of the police person.
      2. Contract with a lawyer.
      3. Get an injury certificate from a registered doctor.
      4. Issue a case against that police in the competent court under section 330, 331 of Penal Court.
