Legal Aid means the solution of legal problems to those common people who cannot sought it due to economical problem or through the lack of knowledge of law. The opportunity of such aid may be received from the government or from the non-governmental organizations. The Constitution of the People's Republic of Bangladesh is the supreme law of our country. All other laws existing in our country are by virtue of the constitutional law. The fundamental rights and some other special rights of the citizen are illustrated in this constitution. Of course, at the same time the rights and duties are mentioned. The law says that law is equal for the rich and poor. But the vary truth is that the unparallel ability and effort of the rich and poor obstructs to sort the legal aid equally.In this circumstances, it becomes difficult to help the poor people within the sphere of existing laws, though somebody may have the good wishes. Before ascertain the methodology to help to the poor by government or non-governmental organizations, it is the prior most job to establish the concept of "law of the poor rather than law for the poor". Because the criticality of existing laws make this way very difficult.Most of the laws in vogue in our country are derived from rule of British colonialism. The British Rulers enacted the regulations of taxes and administrative law in different form to rule the people of this sub-continent. That's way the imbalance occured in social, political, economical life and influenced the races and religions. After the independence of Bangladesh, it has inherited all the laws and regulations of colonial rulers, though it is a feeling of common people to amend these laws but still it is not being done. If we can overcome the colonial traditional laws then there will be no discriminations between the citizens. If we want to give the legal aid to the poor we must amend these laws very immediately. At this moment if think to have the legal aid, we have to think it in a very narrow sphere. Some few Acts have been enacted to satisfy the poor and some privileges have been established due to enactment of few laws for the poor. But these are not enough to build self-respect of an individual. The following may be considered as the laws for the poor:
The opportunities in terms of government and non-governmental organization, the later prevails more. Legal Aid and Services Trust, Institute of Democratic Rights etc. are the non-government voluntary organizations serving for the poor litigants and are trying to establish the rights of poor. This may be very little in terms of requirements and demands but it is really a great help and a sincere attitude towards the nation. |
